    yeah logins and the checkout shared the same piece of code which had a little snafu in them from switching over to Intl. But everything is good to go now!

    A more serious matter, however - this design was just up on woot not two weeks ago. It's a great design, but this is clearly in violation of the contract that was agreed to by the artist when she submitted it in the Text As Art derby. Woot has a 60-day hold on all designs submitted. I'm not sure what this legally means for the artist or TeeFury, but you guys will probably have to figure this out quickly.

    Another important note: This shirt received an Honorable Mention on woot, and thus, it is slotted to reappear in the next Do-Over derby (probably next week).

    I also sent them an email, suggesting that they modify their text filters to replace the word "smurf" with "JadenKale" and vice-versa.

    The Woot staff seems pretty cool so I don't think they'll begrudge an artist making some money off a design their customer base clearly didn't want. It also isn't in their best interest to bully another t-shirt site and take money from an artist's pocket.

    Hello everyone - we really have to rely on the artist to be forthcoming with us in these matters - a side email has been sent to Joel - lets see what they say - we really had no idea - we have enough to worry about at TeeFury - we don't have time to verify all designs - although we do deny designs when we know a piece of art is still in the running somewhere else.

    Having said all that - at TeeFury artists retain 100% of their rights - so therefor Woot can still print this piece under their contract, an Artist owns their work until they have been paid for their work - the 60 day limit on woot, or limit on any other tshirt site is there to protect against other contest sites, simply because it takes time to choose winners, get tees printed etc.

    In our experience, artists have been able to email anothersite, dbh etc. and ask to have their design removed and every time the corresponding contest site has been very cool and let the artists have their work back - I am not sure how or what woot will do - however we intend to continue selling this tee for the remaining 24 hours unless we hear diffrently from the artist or woot.

    Joel from Woot e-mailed me and told me to let him know if I wanted to use this design elsewhere. When I found out that Tee Fury wanted to print it, I e-mailed him to get it released, so it won't be appearing in Woot's Do-Over derby.

    Hello Everyone!

    Wow this is a bit of a pickle. Just so everyone is clear we ask the artist if their artwork is available and 99% of the time the artist will let us know if the design is under contract at anothersite, dbh, woot etc. In this case we did not verify what the artist told us - we trusted them (having said that, we do deny art weekley which we see in the running at other contest sites).

    Joel - its your call - we truly had no idea - we have already taken orders on this tee, and would incur some serious costs in taking it down (we are only 90 days old) - with TeeFury the artist retains all the rights, there is nothing prohibiting Woot in STILL printing this design - teefury is not a typical contest site.

    Thanks in advance for your clarification - Also - perhaps you would grant Jaden to be released early also - anothersite, DBH all allow their artist to take their work back if they write in and request - I am only working off this email and have not had a chance to talk with Michael and Anik -

    I think the fault is %100 in the artist's corner if a 60 day agreement is violated. The agreement is between the artist and a shirt contest site and almost always involves a non-submission clause for giving a design to other sites within a designated time period.

    If this shirt got an HM at Woot(!) it's theirs for 90 days unless the artist specifically wrote them and asked them to let him have his design back.

    Derek, I think it's actually 180 days, not 90. Not sure though. And I agree - the responsibility lies with the artist for being honest. It may actually be that she didn't realize there was a hold on the design - unfortunately, too many people don't take the time to read what they are agreeing to.

    If anyone knows - has Woot ever been in this position before, and if so, what did they do? My impression of woot is that they would find a way to work it out...

    it is obvious that refusing the HM at woot left it free earlier than the usual time period.

    Woot(!) has released designs back to artists early before (I can think of at least one specific instance way back in the 'visual sound' derby)

    Layne: May I recommend creating a simple electronic form that your designers can submit to you? In that form, you could ask if the design has been printed before, if so when, and if not is it still under a written agreement with another site. This needn't devolve into a horrid "we love legal stuff" situation. Just better to know up front if there are issues--and to be able to have something to point back to and say, "Uh, dude, 'member this?" if the designer "forgets" to tell you something.

    (Yes, as it turns out, this designer had received a release from Woot. If you had known that in advance, you could have noted it in the description and none of this would have been necessary.)

    agree Derek. the fault lies in the artist who signs the contract when submitting. a form would be good to confirm, but its impossible for teefury to verify considering all the venues an artist has.

    since teefury lets it go in 24 hours, kind of a no contest imo....

    Out of the Do-Over Derby perhaps, but not out of the 60 day agreement with woot just for entering it in the derby. Joel has always held steadfast to that contract. You click agree every time you enter a design.

    Derek - I'm actually interested as to which design you are referring to.

    A release from the do-over is not the same as a release from the original contract. All entries are under a 60 day hold. Honorable Mentions are held longer, as they have potential to be printed again during a second-chance derby and subsequent editor's choice prints. They can opt out of this second-chance. They cannot opt out of their contract.

    I see this all as being totally moot anyway, though. I doubt woot will do anything, leaving plenty of other designers who surely have asked for early release from the contract disenfranchised, and leaving future requests unapproved because they WILL come spilling in. And it will be one more way woot has screwed their entire designing base over.

    I put no fault on Teefury for this. No one can catch everything. But it will only end in a mess.

    I too doubt woot will do a thing because they are lackadaisical about all of their own rules lately and couldnt be bothered to follow through.
    at the very LEAST this will give the rest of us an idea of how important following that agreement is in the future... who knows maybe we can get a three headed dog shirt next week! ;)

It's Friday night people and we have real issues to worry about like electing an intelligent President. So buy a shirt and then mark your calendar and go vote when it really matters. Obama for crowd sourcing t-shirt sites!

    I do not fault teefury at all. But, this does open a can of worms for sure. If woot says this is cool then they will need to do that for everyone will all artwork not yet printed.
    It is great to see teefury grow as I have been following them since very early, but I am not 100% sure that I follow the DBH partnership?

    i just recieved my "its all just a fad" shirt in the mail yesterday. i love it! the material is nice and the shirt fits great. i will definitely be buying from teefury again in the future

    I'm just overall kind of bummed with teefury. They were printing such great stuff in the beginning and lately it's been less than exciting. With all the artist submissions that I'm sure they're getting, they have to pick something that woot has rights to? What about designs like the hummingbird - Beautiful, artistic things? Haven't seen anything like that for some time now.

    Lots of new stuff on TeeFury today. Congrats on getting international shipping going. I'm sure our friends across the ponds will be stoked!

    As for this design... I caught myself staring at it for a good five minutes following all the lines and creating a silly maze in my head. I would have bought it if it were on a different color other than white. I have a thing with throwing food on myself when I eat... so this shirt would get trashed. (6am coffee doesn't always make it to my mouth :(.. )

    Aside from all the useless drama... Congrats on the print TheArtRobot.

    It's rather disgusting to me that you people have less respect for a contract than for someone who is concerned about making sure that contract is dealt with fairly for all designers involved. This isn't about getting what you want. It is about a fair treatment of one's constituents. If this design was freed from its contract, there are going to be PLENTY of wooters who are ticked off because woot never allowed them to be free when they asked, and plenty more who WON'T be allowed out because woot is hugely inconsistent... they somehow think a single allowed mistake is just OK to their art base, and isn't unfair to all the people who legitimately have a concern and will never have it answered. If woot DOESN'T make a ruling on this, it will just lead to EVERY woot designer without any sense of being a stand-up human being breaking the contract they signed, knowing that a quick buck is more important than being honorable. And who are you supporting? The person who broke the contract. Because you want your shirt. Because you are so over-entitled as to think that your desires are above contract, are above rules. You'd rather insult people for standing up for what is right than admit that you are wrong. That's what teefury gets for catering to the same audience of ignorants as woot. Grow a pair. The people who submit to these contests and sites have more rights in them than you do. They should have the inalienable right to have the rules enforced fairly for ALL entries. You don't have the inalienable right to get anything you want, regardless of what rules are broken.

    Yes, some rules were broken, but it's just a t-shirt for goodness sake. And, it is between TeeFury and Woot (ie, YOU can't tell them what to do - it is THEIR business). We support the artists, plain and simple. I just think that you and Jadenisnotmyrealname need to take a break from t-shirt sites. You're both treating this as if the artist has done some huge war crime and needs to be indicted by the Hague. Easy on the overreaction, you two.

    Adder, you've never had any of your shirts printed. Use your pent-up anger and time towards something more productive. Like practicing drawing and graphics instead of bitching about the rules, Woot, and TF.     WHOA, WHOA, WHOA! What's with all the hating? These are people who are concerned about something that is dear to them. Who the hell are you people to say they should get a life and care about something less? Jaden (who gives a smurf what her real name is?) in particular is concerned from a business standpoint AS A DESIGNER. Designing shirts, among other means, is how she eats and keeps a roof over her head. And you are telling her not to care?

    Enough venting. I, as a very amateur designer, am also outraged at this situation. I have a few designs that I put a lot more time than usual into and would have loved to immediately bring them over to TeeFury (where I plan to submit them as soon as I get the rights back), but did not because I agreed to a CONTRACT. And before I ever entered a derby, I READ that contract from beginning to end. Why should my good ethics be punished while someone else's disregard for the LAW goes unpunished? Maybe it's just a t-shirt to some of you, but to some of us, it's a hobby into which we've put a lot of time and money and energy often in the hopes to get something back. Or at least to have a fair and equal opportunity to do so. If others are allowed to break their contracts without any repercussions, however, we honest folks have no chance of competing.

    This IS an issue between Woot and TeeFury, but they deserve to know what the reactions of their designers (the people who make them money) will be if they make an unfair decision.

    I, personally, liked this shirt when it appeared in the derby and probably would have bought it if it went up for sale in a month and a half or so when it's contract with woot was over. I refuse, however, to give my money to support an artist who doesn't follow the rules.

    And here we are, with the same old smurf, caused by the same old people. Woot isn't enough of a soapbox for the complainers, they have to bring their whine here, too.

    I love it when Woot prints a daily by someone like Rob Glenn, then adds a line about him being controversial. They're aiming that remark right at the small Woot clique of viciously critical, uber-controlling, tantrum-throwing whiners, saying, in essence, "Hey, you don't make policy here, we do. Grow up."

    If Woot and TF are cool with the shirt, that's all you need to know. Stop with the "wounded artist" routine. Life isn't fair. When you participate in t-shirt design venues, you have to learn to accept that.

    What the hell is wrong with you people? Do any of you besides Layne have even a remote grasp of maturity? Do any of you understand why contracts exist, or what they mean? This is not drama. This is how the world works. You do not sign contracts to renege on them. It's legally in woot's power to sue the artist for breaking the contract. It's legally in the power of other designers to sue woot for breaking that same contract with them by allowing someone else to go unpunished. If we all wimp out on every count, if we cannot stand up and fight for something, if that is somehow only pointless drama, then why bother having any rules at all? This is something that effects everyone here, from the designers who care, to the designers who don't, to the children, er, customers who think it's all about them. It is just as bad if woot does nothing. Think about the further ramifications before you try to slander the ones who are giving the legal facts.

    Adder, you can't even see that you're the one creating the chaos with your insistence that everyone do everything the way you want it done. It's not legalities, or playing nice that you care about. It's control. You've tried for many months now to bring Woot to heel and they're to the point where they're laughing at you. You and your band of malcontents need to find somewhere else to throw yourselves on the floor, scream, and kick your heels every time something happens that doesn't fit your idea of what's right. We're SICK of your incessant complaining. Now you've brought it here, thanks a lot, you ruinous, out-of-control child. Woot and TF came to an agreement with the artist, LIVE WITH IT.

    The way I see it, some people have voiced concerns over a rule at another site that they have been abiding by, despite the inconvenience it sometimes causes. That's pretty understandable. If Teefury and Woot have indeed come to an understanding over this, that's great- I hope this new less than 60 days option will now be made available to other artists who request it as well.

    What I have trouble understanding is the personal attacks. To me, that's just not defensible at all, and it turned what should have been a measured, adult discussion into a carnival sideshow.
